Terms & Conditions

Article 1: Preamble

These terms and conditions are agreed, firstly, by the company Tone Singleton LTD whose registered office is at 1090 Jette / Brussels / Belgium, Rue Henri Werrie, 6, placed on the ECB under the above number BE0538.927.644 -hereinafter referred to as "the seller" and, secondly, by any person or entity wishing to make a purchase via the website of the seller, hereinafter referred to as "buyer".



Article 2: Objective

These terms and conditions aim to define the contractual relationship between the seller and the buyer and the conditions applicable to all purchases made through the website of the seller, by the buyer either as a professional or a consumer. The acquisition of a good or service through this site implies a general acceptance by the purchaser of these conditions of sale.

These conditions shall prevail over any other general or special conditions not specifically approved by the seller.

The seller reserves the right to modify terms and conditions at any time. In this case, the conditions will be those in force on the date of the order by the buyer.



Article 3: Characteristics of goods and services

The products and services offered are those listed in the catalogue published on the website of the seller.

Each product is accompanied by a description provided by the supplier.

The photographs in the catalogue are as accurate as possible but cannot ensure a perfect similarity with the product, especially with regard to colour.

These products and services are offered within the limits of available stock. If, despite its best effort, any of the items are unavailable, the seller shall inform the buyer by email as soon as possible and offer the possibility to choose between waiting or canceling the order of unavailable items. Available items will be delivered normally.



Article 4: Rates

Prices of products and services on the site are indicated in euro including all taxes (VAT and other applicable taxes).

The seller reserves the right to change prices at any time. However, the prices applicable to the order are those in effect at the time of order confirmation.

Prices do not include order processing, transportation and delivery if they occur in the geographical areas set out below.



Article 5: Location

The online sale of products and services presented on the seller’s site is for buyers who reside in Europe and delivery is required to be in these areas.



Article 6: Order

The buyer, who wishes to buy a product or service must:

  • Complete the identification sheet which shows all the data requested or giving their customer number if applicable;
  • Complete the online order form giving all the references of selected products or services
  • Validate the order after reviewing it
  • Make payment as provided
  • Confirm the order and its rules

The confirmation of the order implies acceptance of these terms of sale, recognition of having perfect knowledge and waiver of their own conditions of purchase or other conditions.

All data is recorded and confirmed as valid proof of the transaction. Confirmation will be considered equal to signing and acceptance of transactions.

The seller will email confirmation of the order recorded.



Article 7: Right of withdrawal

According to the law, the consumer has the right to notify the seller that he cancels the purchase without penalty and without giving any reason, within 14 working days from the day after delivery of the product or the conclusion of the service contract. This right of cancellation does not belong to a professional buyer.

Within this period, the consumer must notify his intention to cancel by email and return, at their expense and risk, the product delivered to the administrative headquarters of Tone Singleton Club:

Rue Henri Werriestraat, 6, 1090 Jette / Brussels / Belgium is where products must imperatively be returned in their original packaging, undamaged, with all their accessories, the manual and the invoice / purchase order from the original delivery.

The products returned must not have been unpacked, unsealed or used in any way.

Incomplete goods, damaged, spoiled or soiled by the customer will not be refunded.

The seller will refund the possible payment within 30 days after acceptance of the return of the goods, excluding shipping.



Article 8: Payment

Payment is made via the website by credit card or PayPal.

The items ordered remain our exclusive property until payment of the order by the buyer.



Article 9: Shipments

Deliveries are made to the address indicated on the order form which can only be in the area agreed.

The goods are transported at the risk of the seller until the delivery of the goods to the delivery address specified by the buyer. From that point, the buyer assumes all responsibility and risk. Delivery times are provided for information purposes only; if delivery exceeds thirty days from the order date, the sales contract may be terminated and the buyer refunded.



Article 10: Warranty

With regard to consumers, the seller guarantees that the products it sells and that the services it offers are in accordance with the law of 1 September 2004 on consumer protection in case of sale of consumer goods (Articles 1649 to 1649g of the Civil Code).

In case of nonconformity of a product within 2 months of delivery of the goods, the consumer must notify the seller as soon as possible precisely by registered letter or email.

This warranty covers only defects existing at the time of delivery of goods. Defects or damage from misuse, such as water, oxidation damage, fall or impact, negligence and wear, is not covered by warranty. Similarly, repairs made by technicians unauthorized by the supplier, will result in the cancellation of the guarantee.

The invoice or delivery docket must be kept as security by the consumer for the original products.

If the product is used for non-private purposes, limited warranty conditions of the manufacturer / supplier are in effect.



Article 11: Responsibility

The seller, in the online sales process, is only bound by an obligation of means and cannot be held liable for damages resulting from the use of the Internet such as data loss, hacking, viruses, break in service, or other unintended problems.

The data contained on the site is also given in good faith. The links to manufacturer’s sites and / or partners are given for information only. The seller cannot be held responsible for the information from these sites.



Article 12: Intellectual Property

All vendor site elements are and remain the exclusive intellectual property of it. Nobody is allowed to reproduce, copy, repost, or use for any purpose whatsoever, even partially, elements of the site whether they are software, visual or sound.

Any single link or hyperlink is strictly prohibited without the express prior written consent of the seller.



Article 13: Personal Data

All personal data required for processing an order are retained by the vendor or its employees and can be transmitted to companies with which the seller - or its suppliers – is working where such disclosure is necessary to process the order.

The user also authorizes the seller to use this data to compile statistics to improve its site, property and the service it offers.

This information can also be used to enable the dissemination by any means of communication, information relating to the commercial activities of the vendor to its customers.

The seller also keeps personal data to facilitate future orders.

The seller will not disclose or make available the buyers information to another company or corporation.

Data kept by the seller may at any time be requested and will be corrected on request.



Article 14: Nullity of a clause

If any provision of these Terms is declared unenforceable under the law in force, it will be deemed superseded by a valid clause whose content is as close as possible to that of the original clause. All other provisions of the general conditions remain in force.



Article 15: Jurisdiction - Applicable law

Any dispute concerning the interpretation or application of this Agreement or any provision thereof shall be settled by the courts of Brussels.

Any contract concluded with Tone Singleton Club is governed by Belgian law.
